Probate occurs after someone dies, with or without a will, in most circumstances. It is a process where the court appoints someone, a personal representative, to oversee the distributing of that person’s property, real and personal, and the paying of the decedent’s last bills. This is a really important job and often comes at a very emotional time. This is why it is important to hire a compassionate attorney who loves this type of work. Most law firms have their paralegal staff handle the probate process, but I choose to do this work myself because I think it is important to make sure that the last wishes of your family member are followed and the process is respected.
